The scope of the EU Whistleblower Directive (2019/1937) has been extended to include breaches of the EU AI Act with effect from 2 August 2026. This means that companies with more than 50 employees in the EU that develop or use artificial intelligence systems must now ensure their whistleblowing channels also cover non-compliance with the AI Act. The assessment to be completed by the European Commission by the end of the year will determine whether the scope of the Directive will be extended further. Turkey-based companies operating in the EU or providing services to EU customers need to review their whistleblowing policies in light of this change.
It is recommended that company-specific obligations be assessed from a legal perspective as well.
